In addition, as Ms. Jenkins is now indefinitely suspended, she is a "person not in good standing" under USTA Rule 4.130 and horses and USTA members associated with Ms. Jenkins or Lucky Lilly Belle Stable are subject to the applicable restrictions under USTA Rules Rule 20.15, 20.17, 22.05, 22.06, and 26.12. To ensure compliance with the USTA’s Rules and Bylaws, the USTA advises its members to consult with officials at the USTA before participating in transactions or engaging in business activities involving registered Standardbreds with Ms. Jenkins or Lucky Lilly Belle Stable. Ms. Jenkins provided falsified financial records to the USTA and misled the USTA and others in investigations to allow her horses to race in the Maryland Sire Stakes at Rosecroft Raceway, therefore engaging in deceptive and fraudulent conduct affecting the outcome of a race. Ms. Jenkins also conspired with Pamela Wagner by agreeing to submit false and fraudulent documents to track officials and by taking acts to carry out this agreement. USTA on 5/29/2025 USTA MEMBERSHIP ACTION FAIRFAX, VA FINED: $445,000 YOB 1958 INDEFINITE SUSPENSION(IND) AS OF 5/29/2025 The USTA is indefinitely suspending Pamela Wagner’s USTA membership and imposing a fine against her in the amount of $435,000.00 for violations of USTA Rule 26.06 (Fraudulent Misconduct by Member), USTA Rule 7.01 (Bona Fide Owner or Lessee), and USTA Rule 20.07 (Conspiracy to Commit Violation of Rules). Evidence gathered in an investigation overseen by the Standardbred Racing Investigative Fund established that Pamela Wagner’s daughter, Kelsey Wagner, acted as a fictitious owner on behalf of her parents, John and Pamela Wagner. Standardbreds were registered in Kelsey’s Wagner’s name to establish a fraudulent ownership arrangement in response to John Wagner’s unapproved medication violations and resulting suspension and Pamela Wagner’s related disqualification by state regulators. John and/or Pamela Wagner were, in every relevant respect, the actual owners of the horses registered in Kelsey Wagner’s name. Pamela Wagner, individually and in concert with others, fraudulently and corruptly effected a false registration with respect to at least the 62 Standardbred horses she transferred to Kelsey Wagner, in violation of USTA Rule 20.06. Horses that raced while registered in Kelsey Wagner’s name did not do so in the name of the bona fide owner, who in many instances was Pamela Wagner, in violation of Rule 7.01. Mr. Eric Cherry is fined $2,500 for each of seven violations of USTA Rule 20.06 (fraudulent
misconduct by member), $5,000 for each of two additional violations of Rule 20.06, and
$5,000 for one violation of USTA Rule 26.16 (failure to submit information), for a total fine of
$32,500. Mr. Cherry knowingly owned at least seven registered Standardbreds with Nick
Surick while Mr. Surick was not a member of the USTA and caused false registrations that
concealed Mr. Surick’s co-ownership of these horses and is fined $2,500 for each of these
seven violations of Rule 20.06. Mr. Cherry engaged in additional fraudulent misconduct by
lying in interviews with the Standardbred Racing Investigative Fund and lying in his
testimony before the USTA committee that investigated his misconduct and is fined $5,000
for each of these two violations of Rule 20.06. Mr. Cherry also failed to produce records
related to his misconduct and is fined $5,000 for this violation of Rule 26.16. The fine has

CONDUCT DETRIMENTAL TO THE BEST INTEREST OF HORSE RACING
An administrative hearing was conducted before the Board of Judges at the Meadowlands
Racetrack on May 4, 2022 with NJRC licensee, Mark Toth. As a result, the Board of Judges
has determined that: On April 1, 2022, owner Mark Toth did willingly and intentionally throw
an object onto the racetrack at the Meadowlands as the field of horses was approaching
the finish line presenting a potentially dangerous situation for the horses and drivers; Mr.
Toth did act in a manner detrimental to the sport of harness racing and to the integrity of the
race itself as well as jeopardizing the health and safety of the horses and drivers competing
in the race; Mr. Toth`s actions are in violation of NJRC rules. As a result, Mr. Toth is hereby
issued a full suspension of his NJRC license for a period of 180 days, July 5, 2022 through
December 31, 2022 inclusive and is also fined the sum of $5,000.00 dollars. The fine
associated with ruling must be received by the NJRC on or before December 31, 2022.
Status as of 7/15/2025 - Subsequent Ruling - By Ruling No. 22MDH101, dated May 25,
2022, the Board of Judges issued a 180 day license suspension and a fine of
$5,000.00 for violation of N.J.A.C. 13:71-1.7, N.J.A.C. 13:71-1.19 and N.J.A.C. 13:71-
7.32(a)3, 4 in connection with throwing a program during the running of the 4th race
at Meadowlands Racetrack as the field of horses was approaching the finish line. Mr.
Toth appealed the decision of the Board of Judges and requested a stay of the
penalties. By Ruling No. 22TRH46, dated June 20, 2022, a stay was granted and the
matter was transmitted to the Office of Administrative Law ("OAL") as a contested
case. On March 3, 2025, Administrative Law Judge ("ALJ") Nanci G. Stokes issued an
Initial Decision which affirmed the finding of violations by the Board of Judges;
however the ALJ found the penalties excessive. The ALJ specifically found that Mr.
Toth's conduct was careless and no harm or disturbance occurred. The ALJ
concluded that a 20 day suspension and a $2,000 fine was more appropriate. At its
May 21, 2025 meeting, the New Jersey Racing Commission ("NJRC" or
"Commission") accepted the ALJ's findings of fact and conclusion with certain
modifications. The Commission found that Petitioner exercised terrible judgment
and displayed conduct that is unacceptable for racing. Based upon its thorough
analysis of the record, the Commission found it appropriate to reject the ALJ's
penalty and issued a Final Decision, dated July 15, 2025, setting forth its decision
and modifications which impose a 30 day suspension and a $5,000 fine. Mr. Toth is
hereby issued a full suspension of his NJRC license for a period of 30 days and is
also fined the sum of $5,000. Said suspension shall begin August 8, 2025 through
and including September 6, 2025. During the period of suspension, Mr. Toth is
denied access to all grounds that are under the jurisdiction of the NJRC for any and

case. On March 3, 2025, Administrative Law Judge ("ALJ") Nanci G. Stokes issued an
Initial Decision which affirmed the finding of violations by the Board of Judges;
however the ALJ found the penalties excessive. The ALJ specifically found that Mr.
Toth's conduct was careless and no harm or disturbance occurred. The ALJ
concluded that a 20 day suspension and a $2,000 fine was more appropriate. At its
May 21, 2025 meeting, the New Jersey Racing Commission ("NJRC" or
"Commission") accepted the ALJ's findings of fact and conclusion with certain
modifications. The Commission found that Petitioner exercised terrible judgment
and displayed conduct that is unacceptable for racing. Based upon its thorough
analysis of the record, the Commission found it appropriate to reject the ALJ's
penalty and issued a Final Decision, dated July 15, 2025, setting forth its decision
and modifications which impose a 30 day suspension and a $5,000 fine. Mr. Toth is
hereby issued a full suspension of his NJRC license for a period of 30 days and is
also fined the sum of $5,000. Said suspension shall begin August 8, 2025 through
and including September 6, 2025. During the period of suspension, Mr. Toth is
denied access to all grounds that are under the jurisdiction of the NJRC for any and

I do have some empathy for some of the medication infractions, when they are not PEDs and micro amounts above limits. On the flip side, the stricter rules hopefully keep a larger % of participants on their toes and honest.
