Mr. Alagna was summoned to a hearing before the Board Of Judges on 9/8/2025. After hearing testimony and presented with evidence the Board of Judges hereby issue the following ruling. Mr. Alagna is hereby issued a 30 (Thirty) Day Suspension that will run from 9/22/2025 ? 10/21/2025 & a Fine of $1,000 (One Thousand Dollars). The Purse of $19,375 (Nineteen Thousand Three Hundred Seventy-Five Dollars) is hereby ordered to be returned within 30 Days of this ruling. During his Suspension Mr. Alagna is not allowed on any racetrack under the jurisdiction and control of the KHRG and any horses owned or trained by Mr. Alagna must require prior approval from the Board of Judges at the Red Mile prior to any and all transfers. Nfld on 9/14/2025 POSITIVE TEST- POST RACE CANONSBURG, PA FINED: $500 YOB 1969 HORSE DISQUALIFIED - PLACED 6, PURSE REDISTRIBUTION Blood sample #930403 collected at Northfield Park on 9/14/25 from the horse Night Shadow was tested by the Ohio Department of Agriculture ATL and was found to contain over the allowable level of furosemide. At a concentration of 140 + - 8 nanograms per milliliter of plasma. This concentration exceeds the regulatory threshold of 100 nanograms per milliliter adopted by the O.S.R.C. Mr. Burke requested a split sample which did confirm over the allowable level of furosemide. Mr. Burke had a hearing via phone with the judges at Northfield Park on 11/23/25. This is Mr. Burke first medication violation in the last 365 days. He is hereby fined $1000. Night Shadow is disqualified and as a result of that disqualification all purse money must be returned for redistribution ($10,000.00).if this ruling is not appealed the penalty will be reduced to a $500 fine and return of purse. O.S.R.C.3769-18-01 (A) (4b,15,16) 3769-18-02 3769-17-43.The fine and purse must be paid by 12/4/25. Mr. Burke has 48 hours to appeal this ruling to the OSRC.

Status as of 9/1/2026 - Subsequent Ruling - Mr. Burke had a hearing regarding ruling #25NFLD-380 in front of a hearing officer and the ruling was upheld. Status as of 9/1/2026 - Subsequent Ruling - Mr. Matthew Rodriguez appeared before the Board of Judges of the KHRG by phone for a hearing after being issued a summarily suspension after violating 810 KAR 3:020 Section 15 – 1 – JJ – 1 and 810 KAR 3:020 Section 15 – 1 – JJ – 2 when hypodermic syringes, needles and injectables were found by an KHRG Investigator during a search of his vehicle on association grounds of The Red Mile on race day 8/24/2026. After being presented with evidence and hearing testimony under oath, the board of judges determine that Mr. Rodriguez did violate 810 KAR 3:020 Section 15 – 1 – JJ – 1, 810 KAR 3:020 Section 15 – 1 – JJ – 2 by possessing syringes, needles, and injectables on association grounds. Actions of this nature violate 810 KAR 3:020 Section 15 – 1 – I, as Mr. Rodriguez purposely violated the rules of the KHRG. Mr. Rodriguez engaged in conduct that is not in the best interest of racing, violating 810 KAR 3:020 Section 15 – 1 – Q. Mr. Rodriguez is hereby issued a Five Thousand ($5000) Dollar Fine and a One Hundred Eighty (180) Day full suspension from 9/1/2026 through 02/27/2027. Mr. Rodriguez is denied privileges and access to all association grounds under the jurisdiction of the Kentucky Horse Racing and Gaming Corporation. Any and all horses owned and trained by Mr. Rodriguez are not permitted to be transferred without prior approval of the Board of Judges of the KHRG.

First and foremost, I have no insight on the Alagna and Rodriguez cases.  We discussed the Alagna case last year.  But all of his stays and appeals basically landed him right back to where he was at this time last year.  He is suspended from Sept 11 thru the Grand Circuit Meet.  This is a big deal and no doubt occupying the judges time, now that all of his horses at The Red Mile need to be transferred to a new trainer with judges approval.

Rodriguez was featured on a Facebook post toward the end of August.  I happened to be in the room when a racing official showed the post to the judges, and they quietly said it was bad timing.  Nothing else was said, and I just filed it away as an interesting observation.  A day or two later the initial ruling became public.

From what I have sensed, the judges take no joy in this part of their jobs.  But they are fair, honorable and perform their duties under the KHRG corporation.  They have shared insights into the process of rulings with me, but they never talked about specific cases.  I knew not to ask.  I have also met one of their investigators, and he too was tight lipped in my presence.  

From my observations the officials are all very professional and take their roles seriously.

Status as of 9/9/2026 - Subsequent Ruling - Mr. Jerry Austin appeared via phone
before the Board of Judges of the KHRG on 9/9/2026 concerning ruling RM2026-008
where Mr. Austin was summarily suspended concerning his pending criminal
charges that occurred on 8/18/2026. After hearing testimony under oath and
presented with evidence the Board of Judges do find that Mr. Austin is in violation of
810 KAR 3:020 Section 15 – 1 – C by having pending criminal charges or is criminally
charged during his license period, 810 KAR 3:020 Section 15 – 1 – Q by engaging in
conduct that is against the best interest of horses racing or compromises the
integrity of operations at a track, 810 KAR 3:020 Section 15 – 1 – X – 8 by
participating or engaging in conduct of a disorderly nature on association grounds
by disturbing the peace. The Board of Judges do hereby issue a Full Suspension
from 9/9/2026 through 12/31/2026 at which time during this suspension Mr. Austin is
denied privileges of all facilities under the jurisdiction of the Kentucky Horse Racing
& Gaming Corporation. Transfer of any and all horses owned by Mr. Austin are
denied pending approval to a person acceptable to the Board of Judges of the

Blood sample #938576 collected at Northfield Park on 8/5/26 from the horse Windsong
Patriot was found to contain Dexamethasone at a concentration of 19 +/- 3 picograms per
milliliter of plasma. This exceeds the regulatory Threshold of 5 picograms per milliliter of
plasma adopted by the OSRC. Ms. O`Donnell waived her rights to a split sample, DNA, and
a hearing. This is Ms. O`Donnell`s first medication violation in the last 365 days. Ms.
O`Donnell is hereby fined $1000 and return of purse ($4,400) if not appealed the penalty
will be reduced to a $500 fine and return of purse. O.S.R.C.-3769-18-01(A)(1,10,13,15,16)

Park on 9/13/26. After considering all testimony during the hearing, she is hereby fined
$1,000 and issued a 30-day full suspension. If this ruling is not appealed, the penalty will be
reduced to a $1,000 fine with the 30-day full suspension stayed pending no further

ScD on 6/26/2026 POSITIVE TEST- POST RACE MECHANICSBURG, OH FINED: $1,000 YOB 1970 FULL - 30 DAYS, 9/25/2026 THRU 10/24/2026 HORSE DISQUALIFIED - PLACED 9, PURSE REDISTRIBUTION OSRC 3769-18-01-A(1,10,13,15,16, 3769-18-02, 3769-17-43, 3769-17-30-B. Blood sample #937158 was tested by the Ohio Department of Agriculture ATL and was found to contain Boldione, a Class 3, Penalty A drug. Blood sample #937158 was provided by #8 Call Him Rocky, who finished 1st in race 4 on 6/26/26 at Scioto Downs and was trained by Mr. Byers. Mr. Byers requested a split sample which was confirmed. Mr. Byers waived his rights to a hearing. This is Mr. Byers first medication violation. Mr. Byers is fined $1000 and given a 365 day full suspension, and the purse earnings of $5500 must be returned to Scioto Downs within 10 days of this ruling, the penalty will be reduced to a $1000 fine, a 30 day full suspension (9/25/26-10/24/26) with 335 days stayed provided Mr. Byers doesn`t have any penalty A or B violations during that period, and return of the purse earnings. #4 is disqualified and placed 9th. The fine must be paid to the OSRC within 10 days of this ruling. Mitigating circumstances were considered in determining the penalties. Following the race, "REMEMBER THE ALAMO" was required to submit blood and urine for analysis. A report from Industrial Laboratories identified the presence of 5Hydroxydantrolene. At Mr. Alagna`s request, split sample testing was performed at an independent laboratory. These testing results did confirm the presence of 5Hydroxydantrolene. This is in direct violation of the rules and regulations of the New Jersey Racing Commission. A hearing was held in the judge`s office at The Meadowlands Racetrack on June 5, 2025. As a result, Mr. Alagna is hereby issued a full suspension of his New Jersey Racing Commission license for a period of fifteen (15) days and is fined the sum of five hundred ($500.00) dollars. New Jersey Racing Commission, Office of Administrative Law ("OAL") Docket No. RAC 14810-25, which resulted in the OAL returning his case file to the New Jersey Racing Commission. At issue in the appeal was Ruling No. 25MDH75, dated July 28, 2025, in which the Board of Judges at the Meadowlands Racetrack imposed a fifteen-day suspension, $500 fine, and 1/2 Multiple Medication Violation (MMV) point for violation of N.J.A.C. 13:71-23.1(a)(b)14, N.J.A.C. 13:7123.6(a)(b)(c)(d), N.J.A.C. 13:71-23.7(a)(b)(c)(d), and N.J.A.C. 13:71-23.8(g)1 in connection with a post-race positive test result revealing the presence of 5Hydroxydantrolene, collected from the horse "REMEMBER THE ALAMO" following its performance in the 1st race on January 11, 2025 at the Meadowlands Racetrack. Mr. Alagna appealed the decision of the Board of Judges and requested a stay of the penalties. By Ruling No. 25TRH10, dated August 13, 2023, a stay was granted and the matter was transmitted to the OAL as a contested case. Mr. Lafredrick Cole fraudulently instructed other licensees to race a horse under his care and custody at Oak Grove in 2025 in the Commonwealth Of Kentucky. At a concentration of 23+/-7 picograms per milliliter of plasma. This exceeds the regulatory Threshold of 10 picograms per milliliter of plasma adopted by the OSRC. Mr. Mc Ilmurray waived his rights to a split sample, DNA, and a hearing. This is Mr. Mc Ilmurray`s second medication violation in the last 365 days. Mr. Mc Ilmurray is hereby fined $1,000. Shark Play is disqualified and as a result of that disqualification all purse money must be returned for redistribution ($2900.00). Pursuant to New York State Gaming Rules 4120.2 (Restricted use of drugs, medications and substances), 4120.3(A)(19) (Equine Drug Thresholds) and 4120.4 (Trainer Responsibility), Jennifer Petrelli, as Trainer of record of JESSIES OUTLAWED, is hereby fined the sum of $1,000.00 and suspended for a period of 7 days. Blood sample #943015 was tested by the Ohio Department of Agriculture ATL and was found to contain Betamethasone, a Class 4 drug, Penalty C drug at a concentration of 79 picograms per milliliter of serum, which exceeds the Regulatory Threshold of 10 picograms per milliliter of serum adopted by the OSRC. Blood sample #943015 was provided by #2 Been Thru Hill, who finished 1st in race 5 on 8/20/26 at Scioto Downs, and was trained by Mr. Walls.
