Mr. Joseph Hershberger was the driver of #7 Social Theories who was in the 9th Race at
Oak Grove on 3/30/2026. Mr. Hershberger did use the whip while no longer in contention
violating 810 KAR 5:070 Section 9 – D – 7.

While driving #2 Al Be Seeing You in race #3 on 4/1/26 he did whipped the horse in an
exaggerated manner by raising his whipping arm above shoulder height and using more
than elbow and wrist action. Mr. Kramp waived his right to a hearing and is hereby fined
$500. The penalty will be reduced to a fine of $300 if not appealed. This is Mr. Kramp`s first

than elbow and wrist action. This is Mr. Macdonald`s fifth whipping offense in Ohio in the
last 365 days. Mr. Macdonald waived his right to a hearing and is hereby fined $1000 and
given a 30 day driving suspension. The penalty will be reduced to a $1000 fine and a 10
day driving suspension if not appealed. O.S.R.C.-3769-17-17 (B)&(C) The fine must be
paid by 4/15/26.

OSRC 3769-17-17-B. While driving #1 Ithaca Hanover during the stretch in race 3 on
4/6/26 at MVR, Mr. Smith did whip the horse using other than wrist and elbow action. This
is Mr. Smith`s second whipping offense in the last 365 days. Mr. Smith is fined $750, the
penalty will be reduced to $500 if not appealed, which is due within 10 days of this ruling.
Mr. Smith has 48 hours to appeal this decision to the OSRC.

Har on 5/4/2026 LAUREL, DE YOB 1976 FINED: $200 FAILURE TO KEEP A LINE IN EACH HAND Mr. Horsey did use the whip in a one handed fashion before the quarter pole. This is a violation of DHRC rule 7.6.13.14.1.2. Mr. Horsey is issued a $200 fine. Taking into consideration, Mr. Horsey`s history of whipping violations, any future violations will receive more severe penalties. Per DHRC rule 10,2,7.6 all fines are do within 10 days of this ruling. Mr. Horsey did sign the waiver of hearing.

PRc on 5/5/2026 MOUNTAINTOP, PA FINED: $250 INAPPROPRIATE USE OF THE WHIP YOB 1971 USTA Rule 18.00 S18.08 (b)2 and (c)3. On 05/05/2026 at PRC, driver Brad Irvine was observed using other than wrist and elbow action and did not pause after three consecutive strikes while driving No.7 BREWSTER BAKER in Race 3. As a result of the violation Mr. Irvine is fined the sum of $250.00 and is suspended from driving only for one day, 05/07/2026. Subsequent violations of this nature will result in increased penalties. All fines are payable within 48 hours of imposition.

The testing is performed using a portable Intoximeter breath testing device. The date of the reported violation was on a qualifier day May 12th, 2026. Driver Scott Cisco tested positive for alcohol with a reading of .016% - Driver Cisco who took breath test a second time registered 0.17%. MRC Rule 7897.0110 Subpart 1 - Should a licensee who is a driver be found to have any level of prohibited medication or alcohol, The licensee is subject to disciplinary actions by the stewards. Driver Cisco is hereby fined the sum of two hundred and fifty ($250.00) dollars and was removed from his qualifying drives on May 12th, 2026. On 5/26/2026 at PRC, as required by all programmed drivers, Michael Oosting submitted to a breath analyzer test that resulted in a reading of 0.13%. (The test was done twice with the same result.) A test with a reading of more than .00% alcohol in the blood is a positive test, and the driver shall not be permitted to drive that day and must serve a suspension of 3 PRC days for the first offense. Mr. Oosting has agreed to take his 3 suspension days on Thursday, 5/28/26, Friday, 5/29/26, and Monday, 6/1/26. Subsequent violations of this rule will result in increased penalties.

Driver Dan Rawlings is hereby assessed a fine of $8,000.00 and suspended from driving for 120 days for using the whip in an excessive manner, using the whip more than 3 times in succession without giving his horse time to respond, while driving ICARUS FALLS N, in the 6th race on August 11, 2025, at Monticello Raceway. (This violation constitutes a 7th violation in this category in a 365-day period.) Further, giving consideration to the frequency of violations and abject failure to comply with the NYS Gaming Commission whipping rules, pursuant to NYSGC rule 4117.8(H)(6), the Judges have referred Dan Rawlings to the Commission for a determination as to his character and fitness to hold a racing license in the State of New York.

Status as of 5/18/2026 - Subsequent Ruling - The Commission met on May 18, 2026, and after consideration and due deliberation of the entire record, adopted the Hearing Officer’s findings of facts but modified the Report as to the conclusions of law and the penalty, given the facts and circumstances of this matter including that the care of the horses is fundamental to the responsibility of the Commission, that excessive whipping of equine athletes 47 times indicates carelessness towards and willingness to violate the rules of the Commission, that such attitude of Respondent is inconsistent with an attitude a trainer licensed by the Commission should have and with the best interest of racing in general, and that the nature of Respondent’s conduct bears on his fitness both as a trainer, whose responsibilities involve the care of horses, as well as on his fitness as a driver. THEREFORE, based upon the entire record (including, without limitation, the evidence specifically relied upon by the Hearing Officer), the Report, and the findings adopted by the Commission, it is hereby ORDERED, that related to matter MO 22-2025, Respondent’s Commission issued occupational license, including all rights to participate in harness racing in New York, is revoked, effective May 18, 2026, with the period of August 28, 2025 to May 17, 2026, representing a suspension of Respondent’s Commission-issued occupational license; and Respondent, as a patron or otherwise, hereby expelled from New York pari-mutuel and harness racing on or off any Commission-licensed race tracks; ORDERED, that pursuant to Notice Number MR 32-2025, Respondent shall pay a $4,000 fine within 30 days of Respondent’s receipt of this notice, which is deemed to have occurred five days after the date of this notice, pursuant to New York’s State Finance Law § 18.
