While driving #5, HUNT FOR CASH, in the 6th race at the Meadowlands Racetrack on
December 5, 2025, Mr. Terpolilli, during the stretch drive, used significantly more than wrist
action only and moved his whipping arm in an exaggerated manner while applying the
whip. That is a direct violation of the New Jersey Racing Commission rule regarding the
restrictive use of the whip. Mr. Terpolilli has waived his right to a hearing with the Board of

A hearing was held in the Judges` office at The Meadowlands Racetrack on August 6,
2025. The purpose of the hearing was to review driver Peter Gerry`s use of the whip in race
1 at The Meadowlands on July 18, 2025. As a result of the hearing, driver Peter Gerry is
hereby issued a driving suspension for a period of ten (10) days and is also fined the sum
of one thousand ($1,000.00) dollars. This is Mr. Gerry`s second offense of N.J.A.C. 13:71-
20.15 within the past year. Said suspension shall be served on ten (10) consecutive New
Jersey race days and will be served on August 23, 2025, August 29, 2025, August 30,
2025, September 5, 2025, September 6, 2025, September 12, 2025, September 13, 2025,
October 18, 2025, October 24, 2025 and October 25, 2025. While driving #1, "SNOWMAN
HANOVER", in the 1st race at the Meadowlands Racetrack on July 18, 2025, Mr. Gerry,
during the stretch drive, applied the whip using other than wrist action only. That is a direct
violation of the New Jersey Racing Commission rule regarding the restrictive use of the
whip. The payment of the fine associated with this ruling must be received by the New
Jersey Racing Commission on or before October 25, 2025. Violation of N.J.A.C. 13:71-

issue in the appeal was Ruling No. 25MDH76, dated August 7, 2025, in which the
Board of Judges at Meadowlands Racetrack imposed a driving suspension for ten

driving "Snowman Hanover" in the 1st race at the Meadowlands Racetrack on July
18, 2025. Mr. Gerry appealed the decision of the Board of Judges and requested a
stay of the penalties. By Ruling No. 25TRH11, dated August 21, 2025, a stay was
granted and the matter was transmitted to the Office of Administrative Law as a
contested case. Having withdrawn his appeal, the penalties issued in Ruling No.

A hearing was held by the New Jersey Racing Commission ("NJRC") Board of Judges at
The Meadowlands Racetrack on Thursday, January 8, 2025 to discuss the actions and
conduct of driver Joseph Bongiorno immediately after being scratched from the tenth race
at The Meadowlands Racetrack on December 5, 2025. A report submitted by the New
Jersey Racing Commission ("NJRC") Investigative unit was also reviewed during the
hearing. In reviewing the investigative report and hearing the testimony at the January 8,
2026 hearing, the Board of Judges determined that Driver Joe Bongiorno did violate several
rules of the NJRC. Mr. Bongiorno did not immediately vacate the racetrack when ordered to
do so when the State Veterinarian recommended the scratch and the Judges had
disseminated the information of the scratch of the horse "Donato Patriot K" from the tenth
race on December 5, 2025. Instead Mr. Bongiorno did turn the horse and continued to
score the horse down at a high rate of speed after being informed that the horse was
scratched. This is a violation of N.J.A.C. 13:71-7.29 (failure to obey the instructions of a
racing official). When Mr. Bongiorno vacated the racetrack, he stopped at the state
veterinarian`s post and used offensive and profane language to the state veterinarian
before returning to the paddock. Once entering the paddock Mr. Bongiorno continued to
disturb the peace while being obnoxious on the grounds of an association as he entered
the paddock office and informed the Paddock Judge that he is not going to fulfill his driving
assignments for the rest of the evening and he is leaving. This was a violation of N.J.A.C.
13:71-7.29 (failure to drive when programmed). These actions created consequences to
many different parties including the wagering public who had already placed wagers on the
remaining four races without the knowledge of Mr. Bongiorno`s departure until after the
tenth race as multi-race wagers had already been placed. This also created a hardship
